WAIVER OF LIABILITY

I, being over the age of 18 years, acknowledge and agree each of the following, on behalf of myself and, if applicable, on behalf of any person under the age of 18 for whom I am a parent or guardian or for whom I have the care and control (a “Minor”):

  1. I acknowledge that a RAC Venue has been made offered to my family and me by Camp Quality, for respite purposes, as part of a request for an expression of interest. This offer is dependent on a confirmation letter and does not secure any accommodation at an RAC Venue on my behalf or behalf of my family. I understand that if I receive a confirmation letter from Camp Quality, for respite care accommodation at an RAC Venue, this waiver will form part of that confirmation letter.
  2. In respect of any Minor accompanying me to the RAC Venue, I acknowledge and agree that I am solely responsible for the supervision of that Minor throughout the duration of the stay at the RAC Venue and have read the terms and conditions for RAC, as provided, and agree to be bound by them.
  3. I assume, on behalf of myself and any Minor, all risk of personal injury, death or disability that might result from staying, or using the facilities, at the RAC Venue.
  4. I understand that Camp Quality or RAC may request that I, and any Minors, immediately vacate the RAC Venue if, in their absolute discretion, they determine that any behaviours exhibited by myself or a Minor are unacceptable.
  5. I acknowledge that Camp Quality or RAC may implement measures to protect any attendees at the RAC Venue, including guests, employees and third party contractors, including but not limited to restrictions to protect against COVID-19. I agree that I will, and will ensure any Minor will, comply with all directions given by Camp Quality or the RAC Venue for the period I, and any Minor, are at the RAC Venue. I also acknowledge that any measures or restrictions put in place by Camp Quality or the RAC Venue do not provide any guarantee against exposure to COVID-19 or any other illness, and that I am ultimately responsible for the health and well-being of myself and any Minors.
  6. To the extent permitted by law, I agree on behalf of myself and any Minors, personal representatives, successors, heirs, and assigns to release and hold harmless Camp Quality, its officers, directors, agents and employees (collectively, the “Releasees”) from any and all claims or causes of action arising out of attending the RAC Venue.
  7. In consideration of Camp Quality allowing me and any Minors to temporarily occupy the RAC Venue, I agree to indemnify Camp Quality, on a full indemnity basis, for all direct and consequential loss, damages and liabilities whether monetary or capable of being converted into money suffered by Camp Quality as a result of, or caused by, or contributed to by me or any Minor, including, but not limited to, any damage to the RAC Venue or property.
